No more extensions – DtC shipping will be gone unless we act.
Due to a lawsuit filed against California, our state’s temporary DtC shipping privileges are set to expire permanently. The lawsuit argues that California’s law—allowing only in-state distillers to ship within the state—violates the Commerce Clause under the Granholm decision. This means that unless we take immediate action, we will lose DtC shipping entirely.
We have a small window of opportunity to fight for a permanent legislative solution, but we need your help right now. The California Distillers Association (CDA) is mobilizing, and we now have the rare opportunity to work with former Senator Bill Dodd and alcohol law expert Ezrah Chaaban, who have extensive experience navigating state alcohol laws. With their help, we can craft a long-term fix that protects our industry—but we must act immediately.
Why This Matters:
When we conducted our survey last year, 100% of distilleries ranked DtC as "Very Important." That response underscores the critical role DtC plays in our industry. In a recent call with five distillers from Senator Laird’s district, the average percentage of sales coming from DtC was over 30%. If we lose DtC at the end of this year, many distilleries will struggle to stay afloat, and some will undoubtedly be forced to close their doors.
Beyond just preserving DtC, this fight presents an opportunity to push for long-overdue reforms. These changes would give California distilleries the same advantages that breweries and wineries have long enjoyed, allowing us to build stronger, more sustainable businesses. If we do not act now, we risk falling further behind while other states continue to modernize their laws to support small producers.
